{"id":4390,"date":"2013-09-25T19:16:03","date_gmt":"2013-09-25T19:16:03","guid":{"rendered":"http:\/\/www.zegabi.com\/articles\/?p=4390"},"modified":"2013-09-25T19:16:15","modified_gmt":"2013-09-25T19:16:15","slug":"icc-responds-to-au-over-kenyatta-ruto-case","status":"publish","type":"post","link":"http:\/\/www.zegabi.com\/articles\/4390","title":{"rendered":"ICC Responds to AU over Kenyatta, Ruto Case"},"content":{"rendered":"<p><a href=\"http:\/\/www.zegabi.com\/articles\/wp-content\/uploads\/2013\/09\/ICC+Uhuruto.jpg\"><img loading=\"lazy\" class=\"size-medium wp-image-4391 alignleft\" alt=\"ICC+Uhuruto\" src=\"http:\/\/www.zegabi.com\/articles\/wp-content\/uploads\/2013\/09\/ICC+Uhuruto-300x151.jpg\" width=\"300\" height=\"151\" srcset=\"http:\/\/www.zegabi.com\/articles\/wp-content\/uploads\/2013\/09\/ICC+Uhuruto-300x151.jpg 300w, http:\/\/www.zegabi.com\/articles\/wp-content\/uploads\/2013\/09\/ICC+Uhuruto-220x110.jpg 220w, http:\/\/www.zegabi.com\/articles\/wp-content\/uploads\/2013\/09\/ICC+Uhuruto.jpg 595w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Today, the International Criminal Court (ICC) responded to a letter by the African Union (AU) regarding the trial of Kenyan President Uhuru Kenyatta and his deputy William Ruto.<\/p>\n<p>In the letter to the President of the ICC on the 10<sup>th<\/sup> of this month, the AU cautioned that the ongoing case was \u201cbeginning to adversely affect the ability of the Kenyan leaders in discharging their constitutional responsibilities.\u201d<\/p>\n<p>It went on to argue that \u201cKenya as a member of the international community and as an active participant in the international arena will clearly be disadvantaged should the Suspensive Effect be allowed to continue. This means that during the absence of the Deputy President at the trial, the President of Kenya will automatically be prevented from meeting his international obligations.\u201d<\/p>\n<p>In response the President of the ICC, Judge Sang-Hyun Song wrote, \u201cthe Presidency has no legal powers to consider arguments and concerns related to ongoing cases, and that such matters should be raised before the relevant Chambers in accordance with the Rome Statute and the ICC&#8217;s Rules of Procedure and Evidence.\u201d<\/p>\n<p>Although African Presidents had supported the move to resolve conflicts in the Hague, many of them are beginning to grow a distrust for the ICC. The AU&#8217;s letter demanded that the ICC transfer the case involving Kenyatta and his vice to a \u201creformed jury\u201d in Kenya capable of handling with the case.<\/p>\n<p>At the close of an AU meeting earlier this year, Ethiopian Prime Minister Hailemariam Deslegn said \u201cAfrican leaders have come to a consensus that the (ICC) process that has been conducted in Africa has a flaw.\u201d He added that although the intention of the court was to maintain order, \u201cthe process has generated into some kind of race hunting.\u201d<\/p>\n<p>The ICC has responded unperturbed by these requests, just falling short of reminding the AU that the ICC \u201cis intended to complement existing national judicial systems, and may only exercise its jurisdiction only when national courts are unwilling or unable to investigate or prosecute such crimes.\u201d<\/p>\n<p>The question, it seems, is not about the establishment of the crime against President Kenyatta and his vice, but in the way the case is being handled. Ugandan President Yoweri Musuveni said \u201cWe know the origin of the past mistakes. The ICC way is not the right way to handle those mistakes.\u201d<\/p>\n<p>He added that \u201cThe ICC in a shallow, biased way, has continued to mishandle complex African issues. Kenya is recovering.
